These Lyft Cash Rewards Terms and Conditions (the “Terms”) constitute a legally binding agreement between you and Lyft, Inc. (“Lyft”, “we”, “us”) governing the Lyft Cash Rewards program (the “Program”). This Program is made available through the Lyft platform (“Lyft App”) and provides Program Members (as defined below) with access to certain rewards (“Rewards”). YOUR PARTICIPATION IN THE PROGRAM AND USE OF ANY REWARDS IS SUBJECT TO THESE TERMS, AS WELL AS THE LYFT TERMS OF SERVICE, WHICH ARE EXPRESSLY INCORPORATED HEREIN. BY PURCHASING, ACTIVATING, OR OTHERWISE USING LYFT CASH REWARDS OR ANY LYFT CASH REWARDS REWARDS , YOU EXPRESSLY ACKNOWLEDGE THAT YOU UNDERSTAND AND AGREE TO THESE LYFT CASH REWARDS TERMS, LYFT CASH TERMS AND CONDITIONS, AND THE LYFT TERMS OF SERVICE (INCLUDING ITS ARBITRATION PROVISIONS). IF YOU DO NOT AGREE TO THE LYFT CASH REWARDS TERMS AND CONDITIONS, LYFT CASH TERMS AND CONDITIONS, OR THE LYFT TERMS OF SERVICE, THEN DO NOT COMPLETE A QUALIFYING AUTO REFILL TRANSACTION (AS DEFINED BELOW).
The Program is offered at Lyft’s sole discretion and Lyft may unilaterally: (i) terminate or suspend the Program, in whole or in part; (ii) change any aspect of the Program, these Terms, Rewards, eligibility requirements and/or qualification criteria, in whole or in part, at any time, with or without notice, even though such changes may affect the value of Rewards already accumulated; and/or (iii) modify or offer different versions of the Program for limited cohorts of Program Members (as defined below) which may or may not include varying Rewards. The Program and associated Rewards are only available in the United States.
Eligibility. “Program Members” means all eligible participants in this Program. Requirements for eligibility to participate in this Program include (1) maintaining a US-based personal account in the Lyft App in good standing, (2) setting up and maintaining a qualifying Lyft Cash automatic refill transaction in the Lyft App (“Automatic Refill Transaction”), and (3) maintaining Lyft Cash as your default payment method for ride payments. The Program and/or certain Rewards may not be available to all users in all regions. Lyft reserves the right to introduce or remove the Program from any market, or modify the conditions under which it is available, in its sole discretion.
By enabling the Automatic Refill Transaction, you authorize Lyft to automatically charge your default payment method at that time for the pre-selected qualifying amount and then again, each time your balance falls below $15 USD. If your default payment method is invalid or fails for any reason, then you agree that Lyft may (1) retry your default payment method, (2) process the balance of the applicable charge to your secondary payment method(s) in the Lyft App until your payment has been successfully processed, and/or (3) remove you from the Program upon failed Automatic Refill Transaction.
Term and Termination. The Program has no predetermined term or termination date and may continue until such time as Lyft, at its sole discretion, elects to designate a Program termination. Participation in the Program is a privilege granted to Program Members, and as such can be suspended, revoked, or terminated at any time by Lyft for any reason, with or without notice. Any fraud or abuse of the Program, failure to follow any of the Terms, and/or any misrepresentation may impact your eligibility for further participation in the Program. If your Lyft App account is terminated, all Rewards will be forfeited immediately upon termination.
Rewards. Program Members may earn certain Rewards on eligible, completed rides. Rewards under the Program may differ among Program Members, and Lyft reserves the right to offer varying Program Rewards to different Program Members. Some rewards are offered on a monthly basis while others are offered continuously depending on a Program Member’s eligibility. Rewards are subject to expiration and do not roll over.
Cash Back. Program Members can earn Lyft Cash back in the form of credits (referred to herein and defined as “Promotional Lyft Cash” in the Lyft Cash Terms and Conditions ). Promotional Lyft Cash can be earned by Program Members on Qualifying Rides (as defined below) once a qualifying Auto Refill Transaction has been completed, and so long as they remain eligible by (1) enabling and maintaining the automatic refill feature, and (2) continuing to use Lyft Cash as the default payment method for ride payments. Eligible rides exclude Wait & Save and Bikes & Scooters (“Qualifying Rides”). Lyft expressly reserves the right to modify or remove any rides excluded from eligibility for some or all Rewards at any time and without notice. Promotional Lyft Cash back earn rates will vary based on the Auto Refill Transaction amount selected by Program Members in the Lyft App. Promotional Lyft Cash will accrue based on the stated earn rates as listed in the Lyft App and on the dollar amount spent on Qualifying Rides, excluding taxes, fees, tips, and Lyft Up donations. Lyft reserves the right to change Promotional Lyft Cash earn rates at any time, with or without notice, at its sole discretion. Promotional Lyft Cash can be used to pay for future rides. Promotional Lyft Cash earned under this Program cannot be used to pay for charges incurred outside of the United States and expires as determined by Lyft. Promotional Lyft Cash expires; the applicable expiration date(s) may be found in the Lyft App.
Flexible Cancellation. Every calendar month following enrollment in the Program, Program Members may receive a certain number of cancellation fee credits for cancelled rides where a cancellation fee is incurred, provided that a subsequent ride is booked within fifteen (15) minutes of the applicable cancelled ride (in each instance, a “Flexible Cancellation”) and that ride is taken and completed. The Flexible Cancellation credit will be applied to the ride immediately following the completed rebooked ride. The number of Flexible Cancellations received, if any, shall be determined by the corresponding Auto Refill Transaction amounts set forth in the Lyft App. Lyft reserves the right to charge a no-show fee if a rider is not at the pickup location when the driver arrives. Any unused Flexible Cancellations received under this Program expire on the first (1st) day of the calendar month following receipt of such Reward. Extra Comfort Upgrades. Every calendar month following enrollment in the Program, Program Members may receive a certain number of Extra Comfort upgrades (each, an “Extra Comfort Upgrade”). The number of Extra Comfort Upgrades received shall be determined by the corresponding Auto Refill Transaction amounts set forth in the Lyft App. Program Members must select the Extra Comfort ride mode in the Lyft App in order to receive the Reward in each instance. Extra Comfort Upgrades are subject to availability and may not be available in all markets. Any unused Extra Comfort Upgrades received under this Program expire on the first (1st) day of the calendar month following receipt of such Reward.
Program Members who do not meet the eligibility requirements will no longer earn future Rewards associated with the Program. Any Promotional Lyft Cash earned prior to loss of eligibility may be used through its applicable expiration date listed in the Lyft App. Any unused Flexible Cancellations and Extra Comfort Upgrades expire immediately upon loss of eligibility.
Disclaimer and Release. The Program and/or any of its features may be unavailable, inaccurate or interrupted from time to time. Lyft is not responsible for any unavailability, interruptions or errors of the Program and/or any of its features or any of the Rewards provided under the Program. Lyft may modify, suspend, or discontinue the Program or any feature at any time without notice. To the fullest extent permitted by applicable law, Lyft disclaims all warranties, express or implied, including but not limited to, implied warranties of merchantability, quality, durability and fitness for a particular purpose.
Waiver. Lyft may waive compliance with these Terms in its sole discretion. Notwithstanding the foregoing, Lyft’s failure to exercise any of its rights under these Terms or its delay in enforcing or exercising any of those rights shall not constitute a waiver of such rights.
Limitation of Liability. By participating in the Program, you agree that Lyft, and its officers, directors, employees, representatives, and agents (collectively, the “Released Parties”) will have no liability or responsibility to you for any losses of any kind with respect to this Program, including but not limited to losses of Rewards. Neither the Program nor any Reward, constitutes or gives rise to any legal or contractual rights by Program Members against any Released Party.
YOU UNDERSTAND AND AGREE THAT YOU AND LYFT MAY EACH BRING CLAIMS AGAINST EACH OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT ON A CLASS, COLLECTIVE ACTION, OR REPRESENTATIVE BASIS. YOU UNDERSTAND AND AGREE THAT YOU AND LYFT BOTH ARE WAIVING THE RIGHT TO PURSUE OR HAVE A DISPUTE RESOLVED AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. YOU REMAIN SUBJECT TO THE ARBITRATION PROVISIONS OUTLINED IN THE LYFT TERMS OF SERVICE.
THIS SECTION WILL SURVIVE TERMINATION OF PROGRAM MEMBER’S PARTICIPATION IN THE PROGRAM.
