LYFT DRIVER REWARDS TERMS AND CONDITIONS

These Lyft Driver Rewards Terms and Conditions constitute a legally binding agreement between you and Lyft, Inc. (“Lyft”, “we”, “us”) governing your participation in the Lyft Driver Rewards Program (the “Program”). Your participation in the Program is subject to these terms and conditions (the “Driver Rewards Terms”), the Lyft Privacy Policy and Lyft Terms of Service (collectively, the “Program Terms”). In the event of any conflict between these Driver Rewards Terms and the Lyft Terms of Service, the Lyft Terms of Service will prevail. By participating in the Program, redeeming Program Points (as defined below), or otherwise accessing any benefits of the Program, you agree to these Program Terms. IF YOU DO NOT AGREE TO THE PROGRAM TERMS, YOU MAY NOT PARTICIPATE IN THE PROGRAM OR USE ANY OF THE ASSOCIATED PROGRAM FEATURES OR BENEFITS.
This Program is being offered at the discretion of Lyft, and Lyft has the right to terminate the Program, in whole or in part, or to change any aspect of the Program, the Program Terms, benefits, conditions of participation, qualification criteria or earning thresholds, in whole or in part, at any time, with or without notice, even though such changes may affect the value of the points, tier levels, benefits, rewards, credits or bonuses already accumulated. Lyft further reserves the right to make modifications to the Program only to limited cohorts of participants in its sole discretion.
Subject to applicable law, Lyft reserves the right to prospectively change, cancel, restrict, modify or otherwise alter these Program Terms at any time, in Lyft’s sole discretion, effective immediately upon being posted to the Lyft Driver application (the “Lyft Driver App”). Changes to these Program Terms will be reflected in an updated version of these Program Terms that will be posted on the Lyft Driver App, and you agree that all changes will be effective upon such posting. By continuing to participate in the Program after posting of the revised Program Terms, you are agreeing to be bound by the revised Program Terms. You agree to regularly review these Program Terms so that you will be apprised of all changes. You can determine when these Program Terms were last revised by referring to the "Last Updated" legend at the top of these Program Terms.
THE PROGRAM IS CURRENTLY BEING OFFERED AS A PILOT PROGRAM, WITH CERTAIN REWARDS AND FEATURES AVAILABLE IN CERTAIN LOCATIONS. YOU UNDERSTAND THAT LYFT MAY TERMINATE OR MODIFY THE PROGRAM (INCLUDING, WITHOUT LIMITATION, WHAT THE REWARDS ARE, HOW YOU EARN THEM, THE DURATION AND AVAILABILITY OF THE PROGRAM) AT ANY TIME IN LYFT’S SOLE DISCRETION. CHECK THE LYFT DRIVER APP TO DETERMINE IF THE PROGRAM IS AVAILABLE IN YOUR MARKET AND IF YOU ARE ELIGIBLE TO PARTICIPATE.
Eligibility
All participants in the Program are "Program Members." You will only be eligible to participate in the Program if you (1) meet all eligibility requirements to be a Lyft driver in the United States and are onboarded as a Lyft driver (a “Lyft Driver”), (2) maintain your Lyft Driver account in good standing, and (3) have an approved home region in a participating market (each, a "Approved Region"). The Program may not be available to all Lyft Drivers in an Approved Region. Lyft reserves the right to introduce or remove the Program from any market, or modify the conditions under which it is available, in its sole discretion.
You may access information about your activity in the Program by visiting your account (your “Program Account”), which may be accessed through the Lyft Driver App. Limit one (1) Program Account per person. Your Program Account and any associated Program Points and Rewards (defined below) are personal to you, and cannot be combined with any other Program Account or otherwise transferred or shared for any reason, including inheritance or divorce. You must not share your Lyft Driver App credentials or give access to your Program Account to others. You are solely responsible for safeguarding your mobile device and account access information, including your Lyft Driver app credentials, or any other information used by Lyft to authenticate you. Lyft is not responsible for any unauthorized or fraudulent access to or use of your account. If you believe anyone has accessed your Program Account, you agree to report any such unauthorized access or use to Lyft help services quickly as possible.
Your Approved Region is assigned based on the information that you provide to Lyft, and usually corresponds to the primary market in which you intend to drive. You may look up your Approved Region by checking your driver account in the Lyft Driver App. Your Program Account, and certain rules of the Program, are intended to be specific to your Approved Region. If you choose to drive in a market other than your Approved Region, your Program Account may not update to the new market, or your Program Account may become temporarily unavailable. You should contact Lyft if you wish to update your Approved Region. Lyft reserves the right to unilaterally update your Approved Region, or to deny your request to update your Approved Region.
Eligible Lyft Drivers may be enrolled in the Program automatically, however, participation is voluntary and subject to the Program Terms. Lyft reserves the right to restrict Program eligibility criteria at any time.
Term; Termination
The Program has no predetermined term or termination date and may continue until such time as Lyft, at its sole discretion, elects to designate a program termination.
Participation in the Program is a privilege granted to Program Members, and as such can be suspended, revoked, or terminated at any time by us for any reason. Any fraud or abuse of the Program, attempt to damage or tamper with the Program website, failure to follow any of the Program Terms, or any misrepresentation may impact your eligibility for further participation in the Program. If your Program Account is terminated, all Program Points associated with your Program Account and any Rewards (including but not limited to Third Party Rewards) will be forfeited immediately upon termination, in accordance with the terms of the specific Reward, as detailed below. If your Program Account is terminated due to fraudulent activity or noncompliance with these Program Terms, in addition to forfeiting all Program Points and Rewards associated with your Program Membership immediately, you will not be permitted to participate in or rejoin the Program.
Further, Lyft reserves the right to seek all remedies, whether available at law or at equity, in the event a Program Member defrauds or abuses the Program.
Earning Points
Program Members will accrue points (“Program Points”) for every full dollar of Eligible Earnings (defined below) that are earned by driving on the Lyft Platform. You cannot earn Program Points for taking rides as a passenger. Program Points are inclusive of Qualifying Points and Redeemable Points (both defined below). Program Points have no cash value. The rate at which you may accrue Program Points from your Eligible Earnings will depend upon your Approved Region and may be changed without prior notice in Lyft’s sole discretion; current rates applicable to your Approved Region can be found at the Driver Rewards home screen in the Lyft Driver App.
“Eligible Earnings” include (a) base ride earnings (comprised of any base fare, time/distance rates, and applicable shared ride pickup fees), and (b) up to $15 in tips per ride. Eligible Earnings will only result from rides that are accepted by a driver, or dropped off, during the specified busy hours in your Approved Region (referred to as “Busy Hours”). Program Points are calculated by multiplying your Eligible Earnings against the rate that Program Points may be earned in your Approved Region (partial Program Points resulting from this calculation will be rounded down to the nearest full point). Busy Hours will vary depending on your Approved Region; details can be found at the Driver Rewards home screen in the Lyft Driver App. Busy Hours may be changed without prior notice in Lyft’s sole discretion. Program Points that you earn from your Eligible Earnings may be adjusted (and your Program Points balance may go negative) if your earnings or tips are modified according to Lyft policies. If your Program Points balance goes negative then you will need to earn enough Program Points to make up the deficit before you can continue to earn points toward your Tier or other Rewards. Eligible earnings do not include incentives or bonuses (such as PPZ, Primetime, Weekly Ride Challenge, Streaks, etc.) beyond the base ride fare and tip.
Lyft, in its sole discretion, may run promotions that allow you to earn Program Points or other benefits. The requirements to earn Program Points or other benefits in this manner will be specified in the promotional materials. Lyft may place additional terms or restrictions on Program Points earned through such promotions. Lyft reserves the right to withhold or deduct Program Points or other benefits obtained through a promotion in the event that Lyft determines or believes that the redemption or receipt of the Program Points or benefits was in error, fraudulent, illegal, or in violation of the applicable promotion terms or these Driver Rewards Terms. Lyft reserves the right to terminate, modify, discontinue or cancel any promotions at any time and in its sole discretion without notice to you.
Program Points and redemptions, as reflected in Lyft records, shall be deemed correct and Lyft reserves the right to correct or modify Program Point amounts at any time based on Lyft records and calculation of Program Account information. If you believe that your Program Account does not reflect the correct amount of Program Points that you should have been awarded, please contact Lyft help services and provide an explanation with documentation as to why you believe there is an error; however, Lyft reserves the right to make the final determination as to whether to adjust your Points balance in its sole and absolute discretion
Rewards Tiers and Qualifying Points
There are 3 Tiers of rewards status: “Silver”, “Gold”, and “Platinum” (“Tier”). The Silver Tier is the lowest Tier and Platinum is the highest. Your “Driving Score” (or your passenger rating) and the number of Program Points that you accrue in a Qualifying Period (defined below) will determine which tier of rewards status that you qualify for.
Periods begin on the first of each month, and end on the last calendar day of each month:
Qualifying Period 1: January 1 - January 31
Qualifying Period 2: February 1 - February 28 (or 29)
Qualifying Period 3: March 1 - March 31
Qualifying Period 4: April 1 - April 30
Qualifying Period 5: May 1 - May 31
Qualifying Period 6: June 1 - June 30
Qualifying Period 7: July 1 - July 31
Qualifying Period 8: August 1 - August 31
Qualifying Period 9: September 1 - September 30
Qualifying Period 10: October 1 - October 31
Qualifying Period 11: November 1 - November 30
Qualifying Period 12: December 1 - December 31
If you do not qualify for any of the 3 Tiers then you will have no Tier. Each Tier comes with its own benefits, perks, and app features, some of which may be enjoyed automatically upon unlocking that Tier, some of which require sign-up (with Lyft or with third parties) and/or activation of partner programs, and some of which require redemption through use of Program Points. These benefits, perks, and app features, are collectively referred to as (“Rewards”). Lower Tier Rewards will remain available upon accessing higher Tiers. The available Rewards associated with each Tier can be found at the Driver Rewards home screen in the Lyft Driver App. Available Rewards may be changed without prior notice in Lyft’s sole discretion.
You may already qualify for a higher Tier when you first become a Program Member. This initial Tier will be based on your activity on the Lyft platform over the current or prior Qualifying Period, whichever is higher, as though you had already been participating in the Program.
For example -- X is already driving for Lyft when the Program is introduced to X’s Approved Region on June 1. X’s driving activity during Qualifying Period 1 of that year would have qualified X for Gold Tier, however, X’s driving activity during Qualifying Period 2 of that year would have qualified X for Platinum Tier. Then when the Program is introduced to X’s Approved Region on June 1, X will start as a Platinum Tier driver and with the number of Qualifying Points (defined below) that X would have earned by that point in the current Qualifying Period.
For the purpose of determining which Tier you qualify for, Program Points are referred to as “Qualifying Points”.
You will automatically unlock higher Tiers upon accruing the required number of Qualifying Points each Qualifying Period, provided that you (a) have the necessary Driving Score (or passenger rating), described in greater detail below, (b) and continue to meet the eligibility requirements set out in Section 1 above. You will remain in the unlocked Tier from the date it is unlocked through the end of the current Qualifying Period and the following Qualifying Period (unless you are suspended from your Tier according to these Program Terms). Some of the Rewards associated with higher tiers will become available immediately upon achieving that Tier, while other Rewards may take several days to activate or may require redemption through use of Program Points to activate. Your Qualifying Points will expire and reset to zero at the end of each Qualifying Period and do not carry over. If you are suspended from or lose access to your Tier for any reason, such as failure to accrue sufficient Qualifying Points or to meet Driving Score (or passenger rating) requirements (described below), then you will immediately lose any Rewards associated with that Tier.
For example -- X becomes a Program Member starting in February (Qualifying Period 1). By February 15, X has accrued enough Qualifying Points by driving for Lyft that X now qualifies for the Gold Tier. X enjoys the Rewards of the Gold Tier for the remainder of Qualifying Period 1. At the start March (Qualifying Period 2), X’s Qualifying Points reset to zero, but X continues to enjoy the Rewards of the Gold Tier throughout that period. However, during Qualifying Period 2 X only accrues sufficient Qualifying Points to qualify for the Silver Tier, and so at the start of Qualifying Period 3, X will enjoy the Rewards of the Silver Tier and X’s Qualifying Points again reset to zero.
The number of Qualifying Points required to unlock each Tier will depend on your Approved Region, and this number may be changed without prior notice in Lyft’s sole discretion; current Tier requirements can be found at the Driver Rewards home screen in the Lyft Driver App. Qualifying Points have no cash value.
Driving Score and Passenger Rating Requirements
You must maintain a minimum Driving Score in order to qualify for each Tier. Your Driving Score is determined by a combination of factors, which may include your cancellation rate, acceptance rate, passenger ratings, service flags, and/or safety flags (certain factors may vary depending on your Approved Market). If your Driving Score falls below the required threshold then you will lose your Tier, and you will remain ineligible to earn that Tier, until your Driving Score improves sufficiently. In certain markets, your minimum passenger rating is required to qualify for each Tier, rather than your Driving Score. In markets that require a minimum passenger rating, you must achieve and maintain the required passenger rating for each Tier in order to remain eligible. If your passenger rating drops below the required threshold then you will lose your Tier, and you will remain ineligible to earn that Tier, until your passenger rating improves sufficiently. Redeeming Points for Rewards (Only Available in Certain Markets)
The final Qualifying Period for eligible Lyft Drivers to earn Redeemable Points is February 1, 2021 through April 30, 2021. Following this period, Drivers will no longer be able to earn additional Redeemable Points. Earned Redeemable Points will expire one year following the Qualifying Period in which they were earned.
Only Program Members with Approved Regions in the markets listed below may be eligible to earn and use their Program points as Redeemable Points. Current eligible markets are limited to Austin, Boston, Chicago, Denver, Minneapolis-St. Paul, Nashville, New Orleans, New Jersey, Philadelphia, Pittsburgh and Washington DC.
For Program Members in qualifying Approved Region, and who qualify for the Silver, Gold and Platinum Tiers, Program Points can be used as “Redeemable Points”, which can be exchanged for Rewards through the Driver Rewards home screen in the Lyft Driver App. Such Rewards may include ride credit (which will expire within 90 days from the date of redemption) and special third party offers. Redeemable Points may also be exchanged for bonuses if you qualify for Gold or Platinum Tiers. The benefits available to be exchanged for Redeemable Points may change or be discontinued.
The available Rewards associated with each Tier can be found at the Driver Rewards home screen in the Lyft App.
Redeemable Points do not reset to zero at the end of each Qualifying Period the way that Qualifying Points do, though they will expire if not redeemed within one year following the end of Qualifying Period in which they were earned. Claiming your Redeemable Points will not reduce your number of Qualifying Points, or affect the Tier for which you qualify. Redeemable Point earning rates and/or thresholds may vary depending on your Approved Region; visit the Driver Rewards home screen in the Lyft App for details. Redeemable Points have no cash value.
You may view your balance of Redeemable Points in the Driver Rewards home screen of the Lyft Driver App. Any errors or omissions on transactions posted to your Program Account must be reported within 30 days by contacting Lyft. You should retain all receipts and records necessary to verify your balance of Program Points; failure to supply necessary documentation may result in an inability to award Program Points or adjustment to your Tier. It may take several days for your Driving Score (or passenger rating) to refresh. In the event of an outage of the Lyft systems, your Program Points may be delayed in displaying in your Program Account. Additionally, if the outage occurs near the end of a Qualifying Period, it is possible the Program Points will not be applied until the next Qualifying Period.
Points and Rewards Generally
All federal, state, and local taxes on Program Points or Rewards are your sole responsibility. Lyft may issue an IRS Form 1099 indicating the approximate retail value of certain Rewards to the IRS for tax reporting purposes.
Lyft reserves the right to expire your Program Points or to modify the rates for the accrual of Program Points at any time. Lyft further reserves the right to modify the number of Qualifying Points required to unlock any Tier, or to modify the redemption rate for Redeemable Points, at any time. Lyft does not guarantee that the Rewards associated with any Tier, or that any Rewards for which Redeemable Points may be redeemed, will remain available. Some Rewards may only be available for limited periods of time and only in certain Approved Regions. Where a Reward is provided or fulfilled by a third party (a “Reward Partner”), the provision of that Reward is undertaken solely by the Reward Partner and Lyft disclaims any and all warranties or liability whatsoever related to that Reward. Lyft expressly reserves the right to modify or remove any Rewards associated with the Program at any time and without notice. Lyft may revoke your Program Points, reduce your Tier, or revoke your eligibility to participate in the Program, if Lyft believes, in its sole discretion, that you or your Driver Account is associated with any fraud, abuse of the Program or Lyft Platform, or any violation of these Program Terms or Lyft’s Terms of Service.
Third Party Rewards
Certain Rewards may be provided by third parties (“Third Party Rewards”). Access to these Third Party Rewards is a privilege that may be revoked, modified, or suspended by Lyft and/or the Third Party at any time in its sole discretion. The provision of any Third Party Rewards will be subject to separate terms between you and such the third party supplying the Third Party Rewards (“Third Party”). By agreeing to receive any such Third Party Rewards, you agree to any terms and conditions placed on such reward by the Third Party. Lyft does not warrant that your use of the Third Party Rewards will be accurate, complete, reliable, current, secure, uninterrupted, always available, or error-free, or will meet your requirements. Lyft does not provide any of the Third Party Rewards. Lyft disclaims any liability arising from the provision of, or your use of, any Third Party Rewards. Disclaimer/Release
The Program and/or any of its features may be unavailable, inaccurate or interrupted from time to time for a variety of reasons outside of our control. Lyft is not responsible for any unavailability, interruptions or errors of the Program and/or any of its features or any the Rewards provided under the Program. Lyft may modify, suspend, or discontinue the Program or any feature at any time without notice. The Program and all the information accessible through it are provided for informational purposes only on an "as is" and “as available” basis. Lyft, our affiliated entities and third party Rewards providers and their agents make no warranties, representations, or guarantees of any kind, express or implied, including but not limited to, merchantability, fitness for a particular purpose, title, non-infringement, and/or accuracy, currency, or completeness, the operation of the Program, the information, materials, content, availability, and products. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to, implied warranties of merchantability and fitness for a particular purpose.
Waiver
Lyft may waive compliance with these Program Terms in its sole discretion. Notwithstanding the foregoing, Lyft’s failure to exercise any of its rights under these Program Terms or its delay in enforcing or exercising any of those rights shall not constitute a waiver of such rights.
LIMITATION OF LIABILITY
BY PARTICIPATING IN THE PROGRAM OR REDEEMING REWARDS, YOU AGREE THAT LYFT, ITS AFFILIATES AND SUBSIDIARIES, AND ITS OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS, INCLUDING ANY THIRD PARTY PROVIDING REWARDS IN THE PROGRAM (COLLECTIVELY, THE “RELEASED PARTIES”) WILL HAVE NO LIABILITY OR RESPONSIBILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY YOU FOR, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND (INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE OR EXEMPLARY DAMAGES) TO PERSONS, INCLUDING PERSONAL INJURY OR DEATH, OR PROPERTY ARISING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM ANY ACTION TAKEN OR NEGLECTED TO BE TAKEN WITH REGARD TO THE PROGRAM. THE RELEASED PARTIES ARE NOT RESPONSIBLE FOR (A) LOSS OR MISDIRECTION OF, OR DELAY IN RECEIVING, ANY REWARDS; (B) THEFT OR UNAUTHORIZED REDEMPTION OF POINTS OR REWARDS OR USE OF A REWARD CAUSED BY CIRCUMSTANCES BEYOND THE REASONABLE CONTROL OF US OR OUR REPRESENTATIVES, AGENTS; (C) ANY ACTS OR OMISSIONS OF THIRD PARTIES; OR (D) ANY ERRORS PUBLISHED IN RELATION TO THE PROGRAM, INCLUDING, WITHOUT LIMITATION, ANY TYPOGRAPHICAL ERRORS, ERRORS OF DESCRIPTION, AND ERRORS IN THE CREDITING OR DEBITING OF POINTS. LYFT RESERVES THE RIGHT TO CORRECT, WITHOUT NOTICE, ANY ERRORS. IN NO EVENT SHALL THE RELEASED PARTIES BE LIABLE TO YOU FOR ANY DELAY IN OR FAILURE TO PERFORM DUE TO CAUSES BEYOND OUR CONTROL, INCLUDING, WITHOUT LIMITATION, ANY ACT OF GOD, AND ACT OF WAR, NATURAL DISASTER, TERRORISM, OR ANY ACT OR OMISSION OF A THIRD PARTY. THE SOLE REMEDY AVAILABLE TO YOU IN CONNECTION WITH THE PROGRAM (WHETHER YOUR CLAIM IS BASED IN LAW OR EQUITY) SHALL BE THE CREDITING OR RE-CREDITING TO YOUR PROGRAM ACCOUNT OF POINTS IN AN AMOUNT NO GREATER THAN THE NUMBER OF POINTS AT ISSUE.
SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY. CHECK LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.
YOU UNDERSTAND AND AGREE THAT YOU AND LYFT MAY EACH BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT ON A CLASS, COLLECTIVE ACTION, OR REPRESENTATIVE BASIS. YOU UNDERSTAND AND AGREE THAT YOU AND LYFT BOTH ARE WAIVING THE RIGHT TO PURSUE OR HAVE A DISPUTE RESOLVED AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE OR REPRESENTATIVE PROCEEDING.
THIS SECTION WILL SURVIVE TERMINATION OF MEMBER'S PARTICIPATION IN THE PROGRAM.
Neither the Program nor any Reward or Third Party Reward or benefit offered by the Program creates, constitutes or gives rise to any legal or contractual rights by Program Members against Lyft.
General
Lyft’s rights and obligations under the Program may be assigned or transferred by Lyft to any third party at any time, and if such transfer takes place, then performance shall be the responsibility of that entity.
